End User License Agreement (EULA)

PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT" OR "EULA") CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING ANY SOFTWARE, GAMES, OR DIGITAL PRODUCTS PROVIDED BY JEYERS DEVELOPMENT.
This Agreement is a legal contract between you ("Licensee" or "User") and Jacob Meyers, operating under the trade name Jeyers Development ("Licensor," "we," "our," or "us").
By downloading, installing, copying, or otherwise using any software, game, application, or digital product distributed by Jeyers Development (collectively, the "Software"), you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Software.
1. Ownership vs. License
- Grant of License: The Software is licensed, not sold. Subject to your compliance with this Agreement, Jeyers Development grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to install and run the Software on compatible devices solely for your personal, non-commercial use.
- Ownership of Software: You own the specific physical or digital copy of the Software media that you acquired. However, Jacob Meyers / Jeyers Development retains sole and exclusive ownership of all right, title, and interest in and to the Software itself, including all code, graphics, audio, design, intellectual property rights, trademarks, and updates associated with it.
- No Transfers: This license does not grant you any title or ownership in the Software, nor should it be construed as a sale of any rights in the Software.
2. Authorized Acquisition
You may only install and use the Software if you have acquired it legally through official distribution channels operated by or authorized by Jeyers Development. Authorized channels include, but are not limited to:
- The official Jeyers Development website.
- Official digital storefronts and release hubs (e.g., Steam, Ko-fi, GitHub Releases).
Acquiring, downloading, or running copies of the Software obtained through unauthorized third-party sites, torrents, or direct re-uploads is strictly prohibited and constitutes a breach of copyright law and this Agreement.
3. Restrictions on Redistribution and Commercial Use
Except as expressly permitted by an applicable open-source license accompanying a specific source code repository, you agree NOT to:
- Re-upload, redistribute, share, mirror, host, or publish the Software (or its compiled binaries, installation files, or digital assets) on any third-party website, server, or file-sharing service.
- Sell, rent, lease, sublicense, distribute, or commercially exploit the Software or any part thereof.
- Package or bundle the Software with third-party installers, adware, software suites, or paywalled content without express prior written consent from Jacob Meyers.
4. Acceptable Use and Malicious Modification
You agree to use the Software responsibly and strictly for lawful purposes. Specifically, you agree NOT to:
- Illegal Activity: Use the Software to perform, facilitate, or promote any illegal acts under applicable local, state, federal, or international laws.
- Malicious Modification: Modify, hack, tamper with, inject malicious code into, or alter the Software’s executable files or binaries in a manner designed to harm systems, bypass licensing checks, or distribute malware.
- Reverse Engineering: Reverse engineer, decompile, disassemble, or attempt to derive the source code of any compiled, closed-source Software binary provided by Jeyers Development, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
- Cheating / Exploits: Create, distribute, or use unauthorized tools, cheats, or automated scripts intended to interfere with intended multiplayer gameplay or security systems.
5. System Dependencies and Third-Party Runtimes
- Dependency Notice: Certain software applications, tools, or user interfaces provided by Jeyers Development rely on external third-party software runtimes and libraries to display graphical components or user interface (UI) views. Specifically, frontend components may require the Microsoft Edge WebView2 Runtime (or equivalent system runtimes) installed on your operating system.
- User Responsibility: You acknowledge and agree that:
- You are solely responsible for obtaining, installing, and updating any required system dependencies, including Microsoft Edge WebView2 Runtime or display drivers, necessary to run the Software properly.
- Jeyers Development is not responsible for performance issues, interface rendering failures, or application crashes resulting from missing, corrupted, or outdated system runtimes.
- Third-party runtimes are governed by their respective vendor license agreements (e.g., Microsoft Corporation).
6. License Revocation and Termination
- Termination for Breach: This Agreement and your license to use the Software will automatically terminate without prior notice if you fail to comply with any of the terms, restrictions, or conditions outlined herein.
- Effect of Revocation: Upon termination or license revocation, you must immediately cease all use of the Software and permanently delete or destroy all copies of the Software in your possession or control.
- Revocation Rights: Jeyers Development / Jacob Meyers reserves the right to deny or revoke access to digital goods, updates, or online services associated with the Software in the event of unauthorized distribution, piracy, or malicious tampering.
7. Disclaimer of Warranties and Limitation of Liability
- "AS IS" Software: To the maximum extent permitted by applicable law, the Software is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. Jeyers Development hereby disclaims all warranties, express, implied, or statutory, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement.
- Limitation of Liability: In no event shall Jacob Meyers, Jeyers Development, or its suppliers be liable for any direct, indirect, incidental, special, or consequential damages (including lost profits, data loss, or system interruption) arising out of the use of or inability to use the Software.
- Liability Cap: In any scenario where liability cannot be excluded by law, the aggregate liability of Jeyers Development to you shall not exceed the amount actually paid by you for the specific Software instance giving rise to the claim during the preceding twelve (12) months.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States, without giving effect to any principles of conflicts of law. Any legal proceedings arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located within Florida.
